Today at work we had 3 guys get a little out of control because they had been drinking. Only two pitchers of beer were served to them and one was completely and utterly trashed. They proceeded to yell curse words at the girls high school bowling team that was practicing at the time. Obviously the team complained. We went over them to and told them to calm down and this was their only warning or they would be kicked out.

I took the liberty and went and told the bartender to cut them off of anymore drinks because it was clear from the little they had it was already proving to be to much. The bartender agreed and when they found out they could no longer buy alcohol they got ready to leave. We took down their liscence plate numbers, year, make and model of their cars just incase they wanted to try and drive home. We then told them that they have been drinking and we were not going to allow them to drive home without a sober person behind the wheel. So they called for rides. It was then noticed a few minutes later that two of the 3 vehicals were missing and they had taken off. I then made this comment. "We did everything we could to prevent them from driving home and even cut their alcohol supply. We can't be liable..."

I was then told that no matter what if someone were to drive home drunk and ended up hurting or killing someone that we could indeed be sued by the victims family or the victim him/her self. I found this completely retarded. So now WE, even after the appropriate measures were taken to stop them from leaving and drinking, that we would be responsible for THEIR actions and mistakes...

I am currently interested and persuing to go to school for criminal justice, and now I am debating it knowing that the justice system is completely flawed in many areas. I could see a lawsuit happening if the bartender did not do his/her job by cutting someone off because he/she may of had to much...but we did cut them off after the THREE of them only had 2 pitchers of beer in a matter of 4 and a half hours. One pitcher to three people supplies enough beer pints for 3 beers. So in reality they only had about 2 beers in them.

Perhaps they had taken drugs with no one noticing, popping a few pills in the bathroom. HOW COULD WE BE LIABLE!? Because the tests they would take would only be measured by the alcohol on their BREATH. The only way blood could be drawn to test for other drugs or even just alcohol is if the suspect in question disagrees with the breathalizer. There for if they were smart enough after they have been caught and possibly took other drugs, they would agree to the breath test and just get a DUI instead of being found guilty of other controlled substances and spend 25 years in federal prison.

COMPLETELY AND UTTERLY STUPID! AND THIS PISSED ME RIGHT THE FRICK OFF!

Mongoose out.

I've never heard of a bar being sued by victims.  Bars can lose their liquer license if they do not follow the rules behind the license but I don't think they are liable for anything their patrons do outside the property line.

They aren't really liable so to say, but they can still be sued and knowing how people sue and get away with shit its always possible.

Okay so I googled some and learned bars really can be sued in civil court for this kind of thing.  And it happens a lot.

It's so stupid. Even if the Bar takes the proper actions to make sure this kind of thing doesn't happen we can still be sued for hundreds and thousands of dollars.

If a drunk driver gets into an accident or is just pulled over because he swerved or something he knows he's in trouble. Many DUI suspects try and get out of the criminal charge by saying they were to drunk and it wasn't really "them" who was driving. Kinda like a skitso type deal. But the fact is they still get in trouble because THEY made the DECISION to become that intoxicated and then step behind the wheel of a car.

We even have a taxi services phone number in plain view for the customers. But here is the kicker. If they leave intoxicated, we can't physically prevent them from leaving...so now they kill someone and we become public enemy #1... Allow us to use physical force to prevent someone from leaving and driving drunk, problem solved. Our bartenders are really good and know most of the people who come in. They know who is driving and who isn't. So some people can get wasted there. And the second we know this guy or girl is driving and has been drinking, they get cut off depending on how many drinks they have had, when they will be leaving and the time frame between those drinks as well as the time when they started drinking and what they have been drinking.

You can sue for pretty much anything today, it's so stupid.

I'm suing you for posting on this message board! I lost 5 minutes of my life and want it back. I am fully prepared to present a lawyer in court!  /sarcasm

Yeah Todd, sounds like BS to me. Major flaw indeed. Are you really thinking about criminal justice? Best of luck to ya, hope it works out  cool

You made the decision to waste 5 minutes of your life reading it when you were not forced too :-P

And yes I am going to persue criminal justice. I am hoping to become a police officer. But if my little episode involving the hospital prevents me, then I'll go for forensics. Either way I decided I will do the art stuff as a hobby. I've become less and less interested in it because I don't want to sit behind a computer desk the rest of my life, gaining 30lbs from snacks and mountian due. I want to be physical with my work. And a police officer is right up my ally.

I'm very good at telling when someone is lying and I am clever when it comes to trapping people with their words. I'm also athletic, work out (sooooo close to 6pack abs...sooo close lol) and I use to be able to run the mile and a half in 4 min and 30 seconds at a steady pace just over a jog. 6'2, strong and in shape...I think I fit the criteria lol.

i used to run Cross Country. i still run now about 2-3 times a week. but to run 1.5 miles in 4:30 would mean you should turn pro, and i should be your agent. i'll, er, we'll make millions!

The prevalence of lawsuits is one of the reasons our society has taken such a turn for the worse.   Our kids are so damned wimpy because the playground equipment is crap due to kids falling on their head and then the school gets sued for negligence because they had an idiot in their classroom.    The kids are getting fat due to this and its only going to get worse.

I have a feeling the Olympic Commitee would have to take their medal back.
